Acceptable Use Policy

This Acceptable Use Policy (AUP) governs the use of Synteq's VPS, VDS, Bare Metal, and GPU server rental services.
Violation of this AUP may result in suspension or termination of the Customer's service. In the event of a dispute between Synteq and the Customer regarding the interpretation of this AUP, Synteq's commercially reasonable interpretation shall govern. Synteq offers flexible services tailored to a variety of needs, but certain activities are strictly prohibited. Below is a non-exhaustive list of activities and behaviors that constitute abuse of our services. If you're unsure about your intended use, reach out to us first.
What is Synteq's definition of abuse?
1. SPAM/UCE, SPIM, and SPIT
Unsolicited email, telephone, or messaging contacts without recipient consent are prohibited. Initiating or knowingly participating in these activities will result in immediate termination of all services and a permanent ban from future services.
2. Illegal content and/or activities
Any content or activity that violates local, state, or federal laws where the service is hosted is grounds for immediate termination of all services and a permanent ban from future services.
3. Malicious content and/or activities
Programs, scripts, code, or files designed to cause harm. Including but not limited to: malware, viruses, or denial-of-service attacks. All are prohibited. Detection of such content or activities will result in immediate termination of all services and a permanent ban from future services.
4. Resource abuses
Resource abuse occurs when any action (intentional or unintentional) consumes excessive system resources (e.g., CPU, memory, disk I/O) in a manner that degrades performance or negatively impacts other customers or equipment. Examples include:
- Sustained overuse beyond the reasonable capacity of your subscribed plan.
- Activities that disrupt shared infrastructure (e.g., excessive CPU or disk I/O on non-dedicated platforms).
- Being a "noisy neighbor" that interferes with the experience of others.
Intentional resource abuse will result in immediate termination and a ban from future services. Unintentional abuse may lead to suspension with an opportunity to remedy the issue, as outlined below.
5. Cryptocurrency Mining and Related Activities
Cryptocurrency mining, blockchain node operation, or any computationally intensive transactional processing is strictly prohibited on VPS and VDS plans unless explicitly conducted on Cloud GPU or bare metal dedicated servers. Attempts to disguise such activities under vague descriptions will still be considered violations. Violations will result in immediate termination and a ban from future services.
6. Resource Usage Guidelines
Synteq maintains ample available resources on our physical hardware, meaning you're entitled to fully utilize the resources allocated to your plan, subject to the following:
- VPS Plans: CPU Bursting is permitted, and we evaluate usage based on the 95th percentile over a monthly period. However, sustained overuse of CPU resources such as: running processes that consistently demand high computational power over extended periods without meaningful variation or purpose may be considered abuse if it impacts shared infrastructure. For example, prolonged high CPU usage for tasks like speculative workloads or inefficient scripts, rather than legitimate bursts for dynamic projects, could trigger a review. We monitor for patterns that disrupt fairness or stability, not just occasional spikes.
- VDS Plans: You have unrestricted access to 100% of your allocated CPU and GPU with no artificial limits, provided usage adheres to this AUP. Sustained overuse isn't typically an issue here since resources are dedicated, but activities violating other AUP terms (e.g., illegal or malicious use) still apply. Disk I/O limits apply on all VDS plans except Cloud GPU plans as every GPU has its own private dedicated disk.
- Bare Metal Plans: Full resource utilization is allowed without restriction, except where illegal, malicious, or abusive activities are involved.
- Shared Infrastructure Considerations: On non-dedicated platforms (e.g., VPS, VDS), disk I/O use must remain within reasonable limits to avoid degrading performance for others. Excessive disk operations that disrupt shared systems will be treated as resource abuse.
We monitor system performance to ensure fairness and reliability for all customers. While we don't impose arbitrary caps, we reserve the right to address usage patterns that harm the stability or performance of our infrastructure.
Enforcement Process for AUP Violations
Synteq follows this process when addressing AUP violations:
1. Immediate Action
- Terminable Offenses: For violations involving SPAM, illegal content, malicious activities, intentional resource abuse, or cryptocurrency mining (outside of dedicated servers), services will be immediately terminated and destroyed, with no opportunity for remediation.
- Remediable Offenses: For unintentional serious resource abuse or other non-immediate violations, services will be suspended and taken offline pending notification and a resolution plan. If the resource abuse or other non-immediate violations are not seriously impacting other customers, we will just notify and give a timeline to remediate the issue before suspension.
2. Notification
A Synteq staff member will open a support ticket to notify the customer of the violation, detailing the issue and required steps to restore service.
3. Resolution
Upon customer acknowledgment and agreement to remedy the issue, services will be restored. The customer will have 24 hours to address the violation and prevent recurrence. Failure to comply may result in termination.
